MOTORCYCLE ACCIDENT LAWYER
We will fight for you
You’ve taken all the necessary steps to protect yourself: you got the proper license, wore the proper safety gear and you followed the rules of the road, yet someone still crashed into you or caused you to take a fall. This happens all too often in the United States and certainly in California where millions of cars and trucks share the road with motorcycles every single day. Protect yourself by talking to a motorcycle accident lawyer.
Quite frankly, there are a lot of different factors working against a person injured after a motorcycle accident. The general public who doesn’t ride motorcycles tends to either not like people who do or take the position that those who ride motorcycles are assuming the risk of being injured should they be involved in a motorcycle accident. The insurance companies know this.
Insurance companies mainly exist to make money and certainly not to give it away. So all of this combined, results in very aggressive claims handling wherein they offer little or no money to people injured in motorcycle accidents. Having a personal injury lawyer does help the situation, but having a motorcycle accident lawyer who knows and understands these types of claims tends to help immensely.
There was a nationwide class-action case, for example, wherein former Allstate employees testified that they were “trained to build rapport with customers and discourage them from hiring layers.” (Bartelme, Tony. STORM OF MONEY: Insider tells how some insurance companies rig the system.
In an article written by Patrick Gunning titled if you love them, let them go, he explains that “insurance whistle blower Robert Dietz, adjusters at Farmers Insurance were ‘taught how to dissuade people from hiring a lawyer in the first place,’ ‘were evaluated annually for this talent,’ and ‘whenever adjusters allowed claimants to retain an attorney, they had to fill out a form to explain to supervisors how they let it happen.’” (Heckman, Candace; Low-ball offers nothing new in insurance industry.Seattle Post-Intelligencer. May 14, 2003.) The reality is that they are not there to help.
The single most important thing to worry about if you’ve been involved in any type of motorcycle accident is your health and safety and that of those around you. Once you’ve assured yourself that you and others are safe and have contacted emergency services, if possible, attempt to do the following:
Obtain information from other drivers such as their names and drivers license, insurance information, vehicle information and license plates; Identify any witnesses and their contact information and if possible, attempt to get their written statement detailing what they saw; do not discuss the accident with anyone except the police officer who arrives at the scene. Do not under any circumstance admit fault.
Finally, if you can, take photographs of the scene, damage, visible injuries and try and take notes of as much information as you can see and remember. All of this will give you a much greater opportunity of attaining just compensation for your injuries from the insurance companies.
People can injure any and all parts of the body during car accidents – even those car accidents that may seem minor or that occur at low speeds (which insurance companies are notorious for denying coverage for or making low-ball offers for.) Injuries can include:
Soft Tissue Injuries
Soft tissue injuries are generally those injuries that occur to the muscles, ligaments, and tendons. People can suffer from pain to their neck, head, and upper back for years following the accident.
Head Injuries
Head injuries all too often result in some form of a concussion, traumatic brain injury, as well as skull fractures. Such injuries can often lead to serious life altering conditions for life. These tend to occur when people hit the pavement or make contact with another vehicle.
Back Injuries
Back Injuries come in all different types and severity. They can range from soft tissue injuries to severe spinal chord damage which can result in non-stop excruciating pain or even paralysis.
